ITC & Patent Roundup: Smart Locks, Wireless Earbuds, and Robotic Vacuums in the Crosshairs
Two active Section 337 investigations target consumer electronics staples, while a serial patent plaintiff keeps up pressure in East Texas. Here's what exporters need to know this week.
Active ITC Investigations: Smart Locks and Wireless Earbuds
Two Section 337 investigations remain active as of this week. Investigation 337-TA-9003 covers certain smart-lock devices and components, while 337-TA-9001 targets certain wireless earbuds and components. No respondents have been publicly identified in either case yet, but importers and overseas manufacturers in these product categories should monitor developments closely. An exclusion order in either investigation could bar infringing products from entering the United States entirely, making early engagement with counsel critical for any company shipping these goods into the U.S. market.
Robotic Vacuum Investigation Settles Out
Investigation 337-TA-9002, covering certain robotic vacuum cleaners, has been terminated following a settlement between the parties. While the terms of the agreement are not public, the resolution means no exclusion order will issue. Exporters of robotic vacuums can breathe easier for now, though the underlying patents remain enforceable and could be asserted again in future proceedings or district court litigation. Companies in this space should review the complaint's patent claims to assess ongoing freedom-to-operate risk.
PatentHold LLC Continues East Texas Campaign
Serial plaintiff PatentHold LLC has two active patent-infringement suits pending in the Eastern District of Texas — one against Acme Electronics (filed January 2025) and another against Beta Devices (filed November 2024). The firm's multi-defendant strategy in a plaintiff-friendly jurisdiction is a familiar playbook. Exporters whose U.S. distribution partners or customers could be drawn into downstream claims should keep tabs on the patents at issue. Companies receiving demand letters from PatentHold should seek specialized IP counsel before responding, as early-stage positioning can significantly affect settlement leverage and litigation costs.
